Key Players and Pathways in the Negotiated Restructuring of the Corporate Crisis
As part of the conference “Key Players and Pathways in Negotiated Corporate Restructuring”, organised by the Bologna Centre for Insolvency Law Studies, one of the most topical discussions concerned the role of banking intermediaries in the early stages of corporate distress.
In this context, our Alberto De Pra dcontributed with an analysis of the interaction between prudential supervisory requirements and the unilateral modification of banking relationships in the course of negotiated corporate restructuring.
A particularly delicate issue, concerning the coordination between the stability requirements of the banking system and the cooperative function of negotiated corporate restructuring, aimed at facilitating business recovery at an early and still reversible stage of the crisis. The contribution is set within a debate of significant practical relevance, where the choices made by financial intermediaries can have a material impact on the effectiveness of early crisis resolution tools.
